Article 2 - Subject

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product with the qualities and sales price specified below, which the BUYER orders electronically from the website www.thefineorganics.com, in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts.

The Buyer acknowledges and declares that they have been informed clearly, understandably, and in an internet-compatible manner by the Seller about the Seller’s name, title, address, phone, and other contact details, the basic characteristics of the product for sale, the price including taxes, the payment method, delivery conditions, costs, the “right of withdrawal,” how this right can be exercised, and relevant authorities to whom complaints can be addressed. The Buyer confirms and declares that they have electronically verified these preliminary details and then placed the order.

The preliminary information on the www.thefineorganics.com website and the invoice issued based on the order made by the Buyer are integral parts of this agreement.

Article 3 - Product/Payment/Delivery Information

The type, quantity, brand/model, sale price, payment method, delivery recipient, delivery address, invoice information, and shipping costs for the product(s) ordered electronically are as follows. The person to be invoiced and the person entering into the agreement must be the same. The information below must be accurate and complete. The Buyer agrees to fully compensate any damages arising from incorrect or missing information, and accepts all responsibilities for this situation.

The SELLER reserves the right to suspend the order if the information provided by the BUYER does not match the reality. If the SELLER cannot reach the BUYER through the phone, email, or postal address provided by the BUYER, the order will be suspended for 15 days. During this period, the BUYER is expected to contact the SELLER. If no response is received from the BUYER within this time, the SELLER will cancel the order to prevent damage to both parties.

Article 4 - Contract Date and Force Majeure

The contract date is the date when the order is placed by the Buyer, ../../…

Force majeure (natural disasters, war, terrorism, rebellion, changes in legal regulations, confiscation, strike, lockout, significant breakdowns in production and communication facilities, etc.) are events that prevent one or both parties from fulfilling their obligations. The party experiencing force majeure must immediately notify the other party in writing. If the force majeure continues for 30 days, either party may unilaterally terminate the agreement.

Article 5 - Seller's Rights and Obligations

5.1. The Seller agrees and undertakes to fully perform the obligations assigned to them in this agreement, except in cases of force majeure, in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts.

5.2. Persons under the age of 18 are not allowed to shop on www.thefineorganics.com. The Seller will rely on the Buyer’s stated age in the contract. However, the Seller is not responsible for incorrect age information provided by the Buyer.

5.3. The Seller is not responsible for pricing errors caused by system malfunctions. The Seller is not liable for errors that may arise from system failures, design problems, or illegal interventions on the website. Buyers cannot claim rights from the Seller based on system errors.

5.4. Purchases can be made via credit card (Visa, MasterCard, etc.) or bank transfer. Orders that are not paid within one week from the order date will be canceled. The order processing time is the moment when the payment is successfully completed, either through a credit card transaction or bank transfer.

Article 6 - Buyer's Rights and Obligations

6.1. The Buyer agrees and undertakes to fully perform the obligations assigned to them in the contract, except in cases of force majeure.

6.2. By placing an order, the Buyer accepts and undertakes to make the payment in the manner specified in the contract.

6.3. The Buyer acknowledges that they have been informed of the Seller's name, title, address, phone number, and other access details, the essential characteristics of the product, the price, payment methods, delivery terms, and the right of withdrawal and has confirmed this information electronically.

6.4. The Buyer acknowledges having read and understood the product order and payment conditions, usage instructions, and warnings and agrees to follow the relevant procedures on the website www.thefineorganics.com.

6.5. If the Buyer wishes to return the product, they agree not to damage the product or its packaging and to return the original invoice and delivery note along with the product.

Article 7 - Order/Payment Procedure

Order: After confirming the total price (including VAT) of the products added to the shopping cart, the order will be processed through the payment gateway. An order confirmation email will be sent before shipment. No shipment will be made before the confirmation email is sent.

Payment: The Buyer can make payments through credit card or bank transfer. Orders unpaid within a week from the order date will be canceled.

Article 8 - Shipping/Delivery Procedure

Shipping: After the order confirmation email is sent, the product(s) will be handed over to the Seller's contracted shipping company for delivery. The delivery time is 30 days from the order confirmation. The delivery period may be extended by up to 10 days with prior written notice.

Article 9 - Product Return and Right of Withdrawal Procedure

The Buyer has the right to withdraw from the contract without any reason or penalty within 14 days after receiving the product. If the product is to be returned, the Buyer must fill out the return section on the invoices and send one copy with the product. The right of withdrawal starts from the delivery date of the product.

Article 10 - Guarantee

Products that are used and cleaned according to the instructions are guaranteed for 2 years against any manufacturing defects, under the conditions specified below.

Article 11 - Privacy

The Buyer’s information provided for payment purposes will not be shared with third parties, except for legal requirements. Credit card information is not stored and is used only for the payment process.

Article 12 - Authorized Court and Enforcement Offices

In case of any disputes arising from the implementation of this contract, the Consumer Arbitration Committees and Consumer Courts in the Seller’s location are authorized.

By completing the order, the Buyer accepts all terms and conditions of this contract.
